Regulations,
Orders and Acts
The
Agri-Food Act, 2004 The Agency Regulations provide the structure and basis by which the agencies must operate. The agencies can amend the regulations by proving to the Agri-Food Council that the change is necessary and that they have the support of the industry for the changes. Once Council has been convinced of the necessary changes, they are then responsible for introducing the changes to the Minister and the Executive Council and the Lieutenant Governor. Each agency also has a set of Orders. The orders provide the details on how the agency will run, including information about the amount of the levy, how the levy is to be collected and basis operational information for the board. Amending Regulations, Orders and Acts When a board/commission wants to amend either its regulations or orders, it must prove to The Agri-Food Council (Council) that the recommended changes are not only beneficial, but also necessary and supported by producers. In order to amend regulations, the board must first prove to the Council that the recommended changes are beneficial for the agency (including its producers). Upon convincing the Council that the recommended changes are beneficial and necessary to the agency, the Council will vote to either pass them or not. If accepted, the Council then forwards the recommended changes to the provincial government bodies that debates the changes and either recommends further changes, approves the changes or disallows the changes requested. If accepted by the provincial government bodies, the changes are then forwarded to the Executive Council and the Lieutenant Governor in Council for their approval/denial. If approved, the amendments are considered changed on the date of signing by the Lieutenant Governor. The process for amending orders is less complicated. Orders are first approved by the individual boards and then presented to Council members. Council members can approve or disapprove the order changes. If the Orders are approved, they are considered legal documents on the date of signing by Council. Development Commissions
